			<content:encoded><![CDATA[<p>A Florida program intended to help homeowners and lenders reach a compromise in foreclosure cases has ended.  The Florida Supreme Court decided Monday to shut down the 2-year-old mediation program due to a low success rate.</p>
<p>The program faced criticism from both lenders and borrowers who typically had already tried and failed to work out an agreement.  The mediation process failed to yield any result in about 67% of cases.  Homeowners believed the program was too connected to the banking industry and therefore leaned more toward their interests.  Some lender representatives were also unauthorized to make changes to mortgages, making the process essentially pointless.</p>
<p>The program began to help address the backlog of foreclosure cases in the court system.  Ideally, the program would have helped to reduce the cases being heard before a judge and alleviate some of the stress on the courts.  However, the low success rate and complaints made the program unsustainable.</p>
<p>Cases already referred to the program will continue, but not new cases will be submitted to it.</p>

			<content:encoded><![CDATA[<p>The federal government has decided that several major banks are not doing a good enough job in modifying home loans through the Making Home Affordable Program, which was designed to prevent foreclosures.  The Obama administration claims that the servicers need “substantial improvement” of their modification practices.</p>
<p>This comes after an audit that revealed shortcomings in the participating lenders’ calculation of income.  Errors were found in these calculations on more than 22% of the loans audited.  The correct calculation of income is important because it determines eligibility for the program and the terms of the modification.</p>
<p>Due to the results of the audit, the Treasury Department has revoked incentives that the banks received for completing modifications.  Last month, the largest lenders received $24 million in incentives, however, that will end until they can demonstrate improvements in their process.  Of the 10 largest loan servicers, the Treasury said none of them are doing a sufficient job with their modifications.  Several others are cited as needing moderate improvement.  Included in the audit were Bank of America, Wells Fargo, and JPMorgan Chase.</p>
<p>All of the banks have denied that their practices are unfair.  JPMorgan Chase has formally disputed the report, claiming that it does not reflect recent changes that have helped more homeowners to modify their loans.</p>
<p>Removing incentives may not ultimately help with the banks’ handling of foreclosure cases, however, because Making Home Affordable is a voluntary program for banks.  To date, the program has been mostly ineffective in curbing the nationwide mortgage crisis.  However, the move does shed light on the banks’ failure to sufficiently address the troubles homeowners are facing.  Hopefully this is just the first step in getting lenders to work toward helping the country out of the foreclosure mess it has created.</p>

			<content:encoded><![CDATA[<p>New today in Seminole County foreclosure news, a recent court filing claims that Bank of America, currently the largest mortgage servicer in America, unnecessarily complicated the jobs of regulators tasked with reviewing the bank’s foreclosure practices.  The review was a result of recent information that was uncovered which showed the mortgage giant used unfair practices in its mortgage processes, including the use of “robo-signers.”  This allowed the bank to sign hundreds of foreclosure documents every day, often with little or no review.</p>
<p>The new accusations claim that the bank purposely hindered the review committee’s progress by being slow to produce documents and other information.  The bank also made interviews difficult by either denying them or involving attorneys or having them present, making it difficult for reviewers to get useful information.</p>
<p>Bank of America maintains that it fully cooperated with reviewers and denies the accusations.</p>
<p>The review found that banks, including Bank of America, did not have proper paperwork in place that would have allowed the Federal Housing Administration to reimburse them for foreclosures sold for less than the remaining balance.</p>
<p>This is not the first time Bank of America has been accused of unfair foreclosure practices.  In addition to the robo-signing and other fraudulent activities it has been accused of, the bank has also been sued over accusations that it routinely misled consumers about home loan modifications.</p>

			<content:encoded><![CDATA[<p>A special program created by legislators to help with the backlog of foreclosure cases created by the housing crisis is slated to end June 30th.  The program, sometimes referred to as the &#8220;rocket docket,&#8221; hired retired judges to go through the mass amount of foreclosure cases.  Many of these cases ended up being dismissed due to inactivity or missing documents.  Of the 150,000 foreclosure cases filed in Florida from July 2010 through the end of March 2011, almost half of them were dismissed.  The program never worked as intended, however, because banks had to slow down the process to avoid dismissal due to inaccurate or missing documents.  While the program did make progress in reducing the amount of cases, many of these will be end up being re-filed, further stressing the courts that now must absorb over 310,000 backlogged foreclosure cases.  For homeowners, the end of the rocket docket program likely means a slower process.  The cases may also be more thoroughly examined by judges than they would have been by the retired judges.</p>
<p>April saw foreclosure filings increase by 18% in the Orlando Metropolitan area, including Seminole County.  This suggests the long-anticipated surge in foreclosure activity may be stating.  It is unclear how Florida&#8217;s court will be able to handle a spike in foreclosure cases.  Officials believe the current backlog will be easily absorbed, but there is some doubt as to whether the courts could take on another foreclosure surge.</p>
<p>As for prices, experts believe that prices will probably not go lower due to the ending of the rocket docket.  More likely, prices will stagnate and remain at current levels until the foreclosure mess it sorted out.</p>

			<content:encoded><![CDATA[<p>In recent Seminole County foreclosure attorney and short sale realtor news, a report released in January shows that the Home Affordable Modification Program, or HAMP, has made very little progress in reducing the number of foreclosures, as the many pending Seminole County foreclosures and short sales show.  A previous blog post of mine talks about how the <a href="http://www.seminolecountyforeclosurehelp.com/2010/05/05/seminole-county-foreclosure-short-sale-realtor-hamp-overview/"target="_blank">HAMP foreclosure prevention program works.</a> You can also read the entire Wall Street Journal article on how <a href="http://online.wsj.com/article/SB10001424052748704692904576166982594828812.html"target="_blank">HAMP has not been that great at reducing foreclosures. </a>Only <strong>one in four of the 2.7 million homeowners who applied for help under HAMP actually received a loan modification that reduced their monthly payments. </strong> The other 75 percent?  They are out of luck.    </p>
<p>Republicans announced Monday that they are considering a bill to end the HAMP program.  Rep. Spencer Bachus is quoted as saying, &#8220;In an era of record-breaking deficits, it&#8217;s time to pull the plug on these programs that are actually doing more harm than good for struggling homeowners.&#8221;   A treasury spokesman countered that the proposed legislation &#8220;would close the door to struggling homeowners seeking relief in the face of the worst housing crisis in generations.&#8221;  The Obama administration pledged to put $75 billion toward the HAMP program, but to date only $1 billion has been used to help struggling homeowners.</p>
<p>The program&#8217;s lack of success is largely due to government red tape, lack of oversight, and bank mistakes and screw ups.  About 2.7 million homeowners applied for HAMP assistance.  Almost half of the homeowners who applied for HAMP did not qualify for the program to start with, and an additional one-quarter were disqualified after being initially accepted into HAMP.   To break it down into actual numbers, of the 2.7 million applicants:</p>
<p>    About 266,000 applicants were denied due to incomplete paperwork or forms lost by mortgage companies.<br />
    About 255,000 were ineligible for the program because they had an &#8220;affordable&#8221; mortgage, even if they were struggling to pay their bills in addition to their mortgage, or the loan amount exceeded the HAMP guidelines.<br />
    About 770,000 homeowners started the program, but were later disqualified, mainly for the same paperwork and eligibility issues discussed above.  Very few of this number were disqualified for failing to make their trial payments on time.<br />
    In the Southern region, approximately 80 percent of homeowners who applied for HAMP assistance failed to complete the loan modification process.    </p>

<td>If your lender forecloses on your home, it can get a deficiency judgment against you.  The amount of the judgment is the total amount owed to the lender, less whatever the lender could recover through a foreclosure sale. </td>
<td>In a successful short sale, it is possible to convince the lender to give up the right to pursue deficiency judgment against the homeowner.  The lender, however, does not have to agree to pursue a deficiency judgment, and can agree to a short sale and then pursue the deficiency.</td>
<td><b>In a succesful HAFA short sale the lender and any second lien holders are required to waive the right to pursue a deficiency judgment against you.</b></td>

			<content:encoded><![CDATA[<p>Many Seminole County foreclosure lawsuits are filed everyday and a common question is what should a Seminole County homeowner do when they are sued for foreclosure?  First, and most importantly, make sure that you file a written response to the Complaint with the Seminole County clerk of court.  Under the Florida Rules of Civil Procedure, you have 20 days from the date you are served with the foreclosure complaint to file a written response with the Seminole County clerk of court.  Note that most banks will actually give you 30 days to file a written response, because state and federal debt collection laws give you 30 days to contest the debt before collection action can be taken.  It&#8217;s best to file within 20 days to play it safe.  </p>
<p>If you do not file a written response to the bank&#8217;s Complaint, the bank will get a default judgment against you, which will make it easier and faster for the bank to foreclose on your home.  </p>
<p>Once you file a written response,  you have some breathing room to consult with an appropriate professional to discuss the best alternative for you and your family.  </p>

Ibanez, has handed down a decision favorable to struggling homeowners in foreclosure. (Just click on &#8220;Supreme Judicial Court Opinions&#8221; then it&#8217;s case number 1 on the following page) The case involved two banks that foreclosed on hapless homeowners, even though the banks could not show that they actually owned the mortgage and note at issue.  Even so, the banks sued for foreclosure and bought both homes at auction for a minimum amount.  The court voided both foreclosures, as the banks could not show valid assignments that would show they actually owned the note and mortgage they used as a basis to foreclose on the homes!!</p>
<p>Hopefully courts in Florida will use the U.S. Bank case as persuasive precedent in deciding future decisions.  </p>
